Common Defenses

There are several defenses that can be taken in product liability cases. A manufacturer may be relieved of liability for injury if:

  • The product was substantially altered after it left the manufacturer’s control;
  • The modifications were not foreseeable; and
  • The changes to the product were a superseding cause of the injury.

The seller cannot be held liable if a safe product is made unsafe by changes by the user.
