There are money damages unique to birth injury cases, compared with common personal injury cases. They are unique, too, in their complexity, and the degree of expertise needed to establish the actual damages. Experts often needed to testify include birth specialists, economists, and rehabilitation specialists. Many states allow parents to collect damages as well, for the values of their services in providing care for the disabled child, or the cost of paying someone else to do so. For example, if a couple has three children and a disabled child requiring round the clock care, the court may cover the cost of a nanny and/or the value of lost income. Damages for emotional suffering may also be available.
