Nursing Home Abuse:

Structured Settlements

Structured settlements are paid out over intervals of time (e.g., once a month), as opposed to being one lump-sum payment. These are becoming a more popular in personal injury cases, but in cases involving the elderly (such as nursing home abuse lawsuits), there are other considerations to take into account.  Namely, will the full settlement be paid out before the victim passes away? On the other hand, structured settlements have the benefits of being tax-free and managed by a third party, and they may be paid out to those surviving the victim in the unfortunate event of his or her passing.

Individuals that could receive a structured settlement after the victim's passing include:

  • Spouses
  • Children
  • Grandchildren
  • Other beneficiaries

Structured settlements in nursing home abuse cases can be right or wrong for different individuals.  A qualified nursing home abuse attorneycan help victims and their families make an informed decision about this and other decisions related to personal injury law.
