Examples of Negligence

Negligence exists when an employer is even slightly careless in causing an injury. The employer has a duty to provide a safe workplace and seaworthy vessel. Examples of negligence include:

  • Failure to maintain vessel and equipment
  • Failure to provide a safe workplace
  • Failure to provide safe equipment
  • Failure to hire a competent captain or crew
  • Failure to provide prompt and appropriate medical care
  • Understaffing a vessel
  • Failure to properly train the crew
