Exempt and Non Exempt Employees

An employee’s job duties are the deciding factor in determining exempt status. It is important to remember that salaried workers are not automatically exempt for overtime pay. Also, job titles do not determine exempt status. Your employer can only deny you overtime pay if you are a salaried employee making more than $455 per week AND your job meets one of the 5 exemption categories.  The five exemptions for overtime pay are the executive exemption, administrative exemption, learned professional exemption, computer employee exemption and the outside sales exemption.
