$1,400,000 Verdict - Workers’ Compensation
That day the Claimant was working in Harrisonburg, Virginia at a construction site where a barn was being built. Claimant was working for a small construction company, Escobar Roofing Company, and it was his understanding that he and two other individuals would travel to the site to assist the general contracting company, Stone Hill Construction, Inc., in the construction of the barn. Claimant and two Escobar Roofing workers were assigned by the Stone Hill Construction foreman to set trusses that day on the barn’s roof. There were approximately 15 individuals working at the site from Stone Hill. Claimant had never set trusses before that day. While moving a truss along the roof of the barn, Claimant lost his balance and fell to the ground injuring himself. Immediately following his accident, Claimant was airlifted to University of Virginia Medical Center and remained in a coma for several weeks. He was initially released from hospitalization in August 2014 but was confined to a wheelchair. In October 2014, he began treatment at a rehabilitation center in Florida. Claimant was subsequently discharged from that program in May 2015. From 2015 through 2016, Claimant continued his rehabilitation at the University of Virginia.
$1,300,000 Settlement - Personal Injury
The claimant, a 32-year-old plumber, was injured on November 20, 2015 when his work van was T-boned by a reckless driver travelling over 100 mph. As a result of the accident, claimant suffered a C2 fracture, a L1 burst fracture as well as T12/L2/L5 fractures which resulted in partial or incomplete paraplegia in both legs. Claimant treated at Chippenham Medical Center where he had back surgery performed by Dr. Placide. Claimant was then referred to The Sheppard Center in Atlanta where he received rehabilitation and learned to ambulate with an ankle and foot orthosis and walker. On July 29, 2016, an Award was entered by the Workers’ Compensation Commission on the claimant’s claim for benefits for temporary total disability benefits in the amount of $431.20 weekly, beginning November 21, 2015. As part of the global settlement reached this April 2017, the workers’ compensation carrier offered more than the total payout of temporary total disability benefits due to Claimant and all available carriers had tendered their limits in the related motor vehicle action. Because the Claimant’s medical condition had stabilized and he had been released to light duty by his treating physician, it was unlikely his treating doctors would support a claim for permanent and total disability. Claimant is currently working with the Virginia Department of Rehabilitative Services to find employment, as he looks forward to rejoining the work force.
