Discussion Topic: CAN I GET UNEMPLOYMENT AFTER RELOCATING?

I recently quit my teaching job in michigan due to stress and also decided to relocate to south carolina for a slower pace and hopefully better opportunity. I filed for unemployment with michigan, but they consider my relocation as quiting . They told me they will send me forms to fill out and forms for my employer to fill out and then the state will decide in 6 weeks if I am eligible. What can expect on these forms and what should I write to insure I get benefits? Should I write that I was severely stressed because the school had no control over students and placed high demand on teachers? Should I include that I believe the work situation compromised my health as I had two incidents where I ended up in the emergency ward for a bacterial infection and virus I believe were brought on by stress? I really felt I was not physchologically and physically able to return to that environment a third year. I suffer from high blood also and i take a water pill and I can recall incidents where students would steal my water bottle or polk a hole in it with a pin. They didn't know my condition, but I needed my water. Maybe in a court the school would argue that was my fault for poor class management, but really the school was out of control and the teens felt they could do anything, there was little respect for teachers. Other incidents included allowing students to skip class in large numbers, maybe 20 kids or more in a hall, and security would tell them to go back to class and as soon as securiy left they were right back in the halls again being noisy and disruptive. I guesss this all relates to another post i placed early regarding workman's comp. Which I may pursue also, but for now I wonder what I can say to assure i recieve unemployment and if I am denied can, because they say these are not legit reasons to quit, can I sue the state? I am not working now and I feel I need time off before i return to the work force. I just don't fill ack to full capacity yet. Hoefully I will be soon.

Generally speaking, you cannot recover unemployment benefits if you voluntarily leave a position. The system is designed to help workers who are out of work through no fault of their own. I would try looking over your state's eligibility requirements for unemployment to see if they apply to your situation. You can obtain these by contacting the Department of Labor. One of the requirements is often that the individual must be actively seeking work, which it sounds like you are not ready to do at the moment. There are unemployment lawyers who help people receive benefits, so you could try contacting one of them to help you find out what your rights are here.
