Dear Sirs, I work for an Irish company as an Administrator/Vehicle Coordinator..In July last year (I can't remember exact date) I was asked by my team leader to lift some heavy object. During my duties I felt pain in my back so  I went to  supervisor and said that I injured my back while I was lifting heavy object. He’s answer was :I'll take care of it .I was working for next 4 months carry on with the pain until I collapsed at home unable to move .I decided to make a claim because company stopped pay me for my sick days. I was working when I could manage the pain ,I am the father of  7 moths twin boys and obviously I needed money to make their life better. In February this year  I collapsed in work and ambulance took me to the hospital. They said I ‘have  slipped disc. What happened when company got letter from Injuries Board says that I am going to sue my employer?...My team leader denied everything that I reported accident to him. Atm I am out of work sick and employer says that they didn't notice any accident happen. All above  case will go to court soon but I have no witnesses I just got my word against my Team leader and manager. Have I got any chances to win?

It is very difficult to predict whether you will win your lawsuit or not. However, preparation is key. To increase your chances of winning, you should get a lawyer to represent you if you haven't already. Good luck.

Thanks a million for your reply.I did speak to lawyer today.
Now it's time to go to court

I will let you know how this case will end up

You have to take immediate action against at the time of accident because court wants proof they don't take any decision without any proof. You have to talk your legal adviser about this situation.Talk again with your team leader about your situation may be he helped it out.

Hello connectwell,

Actually my team leader denied that I reported accident to him.I have no written proof ,what I have is doctors note and documentation from the hospital such as MRI scan which shows I've slipped disc.
Yesterday my manager let me go because of the "recession"...
Anyway thanks lads for advice.I really aprecciate it.

Obviously, your team leader and manager conspired to belie the fact that the accident was reported to them. They are making it appear that your injury is not work related so the company can resist any liability. By consulting an attorney, you can now plan your legal move against your employer.

It is hard to pursue a case without any witnesses. Since the accident happened at work, its impossible that no one apart from your team leader and employer knew about it. It would be even harder if people at your workplace employ tactics to resist any claim.

not saying you can't file but it would be difficult
because it would be your word against theirs.
