Title 32 of the South Dakota Codified Laws details rules concerning motor vehicles. South Dakota DUI law states that drivers with a blood alcohol level of .08% or higher can be charged with driving under the influence. Even if your blood alcohol concentration (BAC) is more than .05% you can still be charged with driving while intoxicated. You can refuse to take a breath, urine or blood test, but your license will be revoked for one year.
First time DUI offenders in South Dakota will face a license revocation from 30 days to one year. Second time offenders will have their license revoked for at least one year.
