The Georgia Supreme Court has upheld the death penalty for a convicted murderer whose lawyer had argued he has "severe organic brain injury" and should not be executed. In a decision released today, Georgia's high court unanimously upheld a Floyd County jury's 2005 finding that James Randall Rogers is not mentally retarded and is eligible to be executed.
