- Criminal Law Possession of Illegal Firearms: Date: Dec 30, 2009 Outcome: Case dismissed. Description: Client was charged with possession of firearms and illegal narcotics. The case went to hearing and we were able to convince the prosecution to dismiss the charges. First Degree Burglary: Date: Oct 14, 2009. Outcome: Case dismissed. Description: Client was charged with breaking and entering and committing an assault. He was facing seven years in prison if convicted. After three day jury trial he was aquitted of the burglary charge and was able to go home with his wife and children. DWI: Date: September 2008 Outcome: Case dismissed Description: Client was charged with DWI even though he was under .08. Prosecution was intent on sticking him with a DWI on his record. We fought for his rights and he eventually received a non-moving violation that did not go on his record. Criminal Sexual Contact Date: October 2002 Outcome: Case dismissed Description: Client was charged with criminal sexual contact with his step-daughter. Client was looking at 148 months in prison if convicted. Turns out that the step daughter had many psychological issues and recanted the allegation. The prosecution still wanted to pursue the charges. We filed a preliminary trial motion and the court dismissed the case. Drugs and firearm possession Date: May 2009 Outcome: Case dismissed Description: Client was charged with possession of drugs and a firearm. The case turned on whether the prosecution could prove that this vehicle was my client's vehicle, and whether he had actual knowlege of the presence of the firearm in this vehicle. They could not establish the necessary link and we suceeded in getting the case dismissed. Murder in the second degree Date: September 2006 Outcome: Plea to a lesser charge Description: Client was charged with intentional second degree murder. Client had many psychological issues, as well as somewhat limited capacity. We had a preliminary hearing wherein we challenged the "confession" made under very questionable police procedure. We won the challenge and got the confession thrown out of court. Client eventually took a deal to a lower charge that reduced his prison time from 21 years to 7 years. Murder in the second degree Date: May 2005 Outcome: Plea to a lesser charge. Description: Client was charged with taking part in a group beating of another individual causing death. The state had evidence against the other 3 assailants, but not as much against my client. We were able to negotiate a plea to a lesser charge that resulted in a reduction of time served. Second degree assault Date: November 2010 Outcome: Case dismissed Description: Client was charged with being involved in a bar fight wherein the victim was beaten badly. Client was not involved in the assault, and the state had limited evidence against him. Based on rumor and innuendo, the state still charged my client with second degree assault. We filed a preliminary motion to dismiss the charges, and the court, after a hearing on the merits of the case, agreed with our position and dismissed the case outright. |
