Brian J Moore

Biographical Information

Brian J. Moore is a Partner in the Labor and Employment Department. Brian has extensive experience representing employers in a wide array of labor and employment disputes, including discrimination, sexual harassment, wage and hour, unemployment, ERISA, unfair labor practice, and union representation cases. He has practiced before in various state and federal courts, as well as before the West Virginia Human Rights Commission, Equal Employment Opportunity Commission, and National Labor Relations Board. In addition, Brian routinely works with Human Resources Managers and in-house counsel preparing and reviewing employee handbooks, conducting supervisor training, and providing consultation regarding employee discipline. He also assists employers with technology-social media issues in the workplace. He has also drafted and litigated employment agreements, arbitration agreements, and covenants not to compete. Brian workes extensively with clients in the banking, healthcare, retail, and coal industries, including representation of coal companies in whistleblower claims under MSHA Section 105(c). Brian is a former Chairperson of the Defense Trial Counsel of West Virginia's Employment Law Committee. He is also an active speaker and writer, and has published numerous articles and chapters.
