As corporate counsel to community associations, we advise boards of directors on how to comply with the Davis-Stirling Act, the Corporation Code, anti-discrimination laws, and all applicable administrative regulations and statutes affecting common interest developments. We advise boards on day-to-day operations, including interpretation and enforcement of governing documents, fiduciary duties of directors, amending and restating governing documents, preparing and enforcing vendor contracts, board meetings, election issues, employment law, etc. We provide boards with policies and procedures and legal counsel for the following: • Water damage disputes • Mold liability • CC&R interpretation • Insurance claims & disputes • Plumbing, electrical & HVAC systems • Windows • Balconies & patios We provide boards with risk analysis, cost estimates, and options when it comes to litigation matters. When dispute resolution is not possible, we litigate aggressively to win the dispute on behalf of our clients.

Mr. Adams is the managing director of Adams Kessler PLC, a law firm with a state-wide practice representing residential and commercial associations as well as resort and retirement communities. In addition, his firm provides mediation services to community associations under the direction of retired Judge Lawrence W. Stirling, the firm’s senior counsel and author of the Davis-Stirling Common Interest Development Act (Civil Code section 1350, et seq.).
